Terms & Conditions of Use

1.Purpose of the Terms

These Terms and Conditions of Use are intended to define the rules of access to and use of the Nail Universelle platform.

Any use of the application implies unreserved acceptance of these Terms.

2.Overview of the platform

Nail Universelle is a mobile application allowing:

• the connection between clients, nail technicians and sellers;
• the viewing of professional profiles;
• the publication of inspirations and content;
• the booking of services;
• the purchase of products;
• access to professional features depending on the subscription taken out;
• communication with the administration via the integrated messaging.

3.Access to the application

Access requires:

• a compatible smartphone
• an internet connection
• the creation of an account
• acceptance of the Terms of Use and the Privacy Policy

Nail Universelle may:

• restrict access in the event of abuse
• suspend an account
• delete an account in the event of non-compliance with the rules

4.Account creation

Access to certain features requires the creation of an account. The user undertakes to:

• provide accurate information;
• keep their information up to date;
• preserve the confidentiality of their credentials.

Each user is responsible for the actions carried out from their account.

5.Types of accounts

The platform offers several categories of accounts:

Client

Notably allows to:

• view profiles;
• book services;
• purchase products;
• publish reviews.

Nail technician

Notably allows to:

• create a professional profile;
• publish content;
• receive bookings;
• manage their activity.

Seller

Notably allows to:

• offer products for sale;
• manage their shop;
• manage their orders.

6.Publications and content

Users are solely responsible for the content they publish. The user undertakes not to publish:

• violent, defamatory or insulting content
• images without rights
• photos of people without their consent
• pornographic content
• unauthorised advertising

The administration may delete any content that does not comply with these Terms.

7.Management of interactions

Users may:

• like inspirations
• add to favourites
• leave reviews about professionals

These features must be used with respect for others. The administration may suspend or delete an account that:

• harasses
• spams
• insults
• publishes illegal content

Reviews and ratings

Clients may publish reviews about the services received. Reviews must be sincere, respectful and reflect a real experience. The administration reserves the right to delete any review that is abusive, fraudulent or contrary to these Terms.

8.Messaging with the administration

The application provides a messaging feature allowing users to contact the administration. This messaging may in particular be used to:

• obtain assistance;
• report a problem;
• make a complaint;
• request the deletion of an account;
• report a dispute.

Users do not have a messaging feature allowing them to communicate directly with each other.

9.Liability

Nail Universelle is not responsible:

• for the services performed by technicians
• for the products sold by sellers
• for disputes between clients and professionals
• for incorrect data provided by users
• for content published by users
• for outages, data loss or bugs

Each user remains solely responsible:

• for their interactions
• for their content
• for their activity on the platform

10.Personal data

Personal data is processed in accordance with the Nail Universelle Privacy Policy. Users are invited to consult that document to learn how their data is collected, used and protected.

11.Payments (Stripe)

Transactions are secured by Stripe. No banking data is stored in the application.

12.Account deletion

The deletion of a user account can only be carried out by the Nail Universelle administration. Any deletion request must be sent via the application's integrated messaging or by email to contact@nailuniverselle.com.

Before any deletion, the administration will in particular verify:

• the absence of any ongoing dispute;
• the absence of any ongoing order;
• the absence of any ongoing booking;
• the absence of any pending withdrawal or financial operation.

Deletion may be postponed until the situation is resolved.

13.Intellectual property

The elements making up Nail Universelle, notably:

• the name;
• the logo;
• the design;
• the texts;
• the features;

are protected by intellectual property laws. Any unauthorised reproduction or use is prohibited.

14.Suspension or closure of account

The administration reserves the right to suspend or delete an account in the event of:

• fraud;
• false identity;
• non-compliance with the Terms;
• abusive behaviour;
• unlawful activity;
• an attempt to circumvent the platform's rules.

Without compensation for the user.

15.Modification of the Terms

Nail Universelle reserves the right to modify these Terms at any time. Users will be informed of significant changes by any appropriate means.

16.Applicable law

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing an amicable agreement, the French courts shall have sole jurisdiction.
